Urgensi Pengaturan Euthanasia di Indonesia (Studi Komparasi dengan Belanda)

Abstract


Euthanasia lies at the intersection of criminal law, health law, and the right to life, yet Indonesia has no rule that brings the three together, whereas the Netherlands has regulated it through a dedicated statute since 2001. This study examines how euthanasia is regulated in Indonesia and the Netherlands within the civil law framework and why regulation is urgent in Indonesia. The locus of the study is the legal systems of Indonesia and the Netherlands. It aims to analyze the differences between the two regimes and to identify the urgency of regulating euthanasia in Indonesia. The study is a comparative legal analysis that applies Radbruch's three basic values of law and the concept of legal vacuum to the legal materials. The materials examined include the National Criminal Code, the Health Law, Minister of Health Regulation Number 37 of 2014, the Dutch Criminal Code, and the Dutch euthanasia act, together with Dutch euthanasia notification data from 2022 to 2025. The findings show that both countries start from a criminal prohibition, but Indonesia has norms that are empty, vague, and potentially conflicting, with no recording or independent oversight, while the Netherlands binds prohibition, exception, conditions, review, and reporting into a single design. Dutch notifications rose from 8,720 in 2022 to 10,341 in 2025, with breaches of the due care criteria at about 0.06 percent. The urgency in Indonesia lies in legal certainty, evaluability, and justice rather than legalization.
