Fundamental Legal Error in the Use of a Non-Existent Article in Administrative Court Proceedings from the Perspective of Legal Philosophy

Abstract


This study examines fundamental legal error (fundamental legal error) arising from the use of nonexistent statutory provisions in State Administrative Court (PTUN) proceedings, analyzed through the lens of legal philosophy. Employing a normative legal method with conceptual, statutory, and philosophical approaches, the research finds that such errors violate the principle of legality, undermine legal certainty, and erode procedural justice. The invocation of nonexistent norms constitutes a jurisdictional overreach that renders judicial decisions legally defective and philosophically illegitimate. From a legal philosophy perspective, this error offends the ideals of justice and the rule of law, necessitating judicial vigilance and corrective measures to uphold the integrity of administrative adjudication.
